Terms of Service

proyectoejecutivo.com is an online marketplace owned and operated by PE BIM LLC, a California Limited Liability Company with principal place of business at 642 Palomar St, Ste 406 516, Chula Vista, CA 91911, USA (EIN: 41-5256539). The Platform connects BIM content creators, MEP specialists, and construction professionals across Latin America and Spain.

The Platform enables three types of users: (a) Creators — architects and engineers who upload and sell BIM projects; (b) Specialists — MEP professionals who provide services on demand; and (c) Clients — construction professionals and developers who purchase BIM content or services.

You must be at least 18 years of age (or the age of majority in your jurisdiction) to create an account. By registering, you represent that all information you provide is accurate, current, and complete. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

PE BIM LLC reserves the right to refuse registration, suspend, or terminate any account at its sole discretion, including for violation of these Terms.

Example: a project approved on June 1, 2026 earns 80% on all sales through November 30, 2026, then 75% permanently — regardless of when the Creator joined the Platform.

Specialists provide professional MEP services across seven disciplines. Specialists are compensated per delivery upon confirmed completion of each engagement — never per hour. Applicable fees are agreed at the time of each engagement.

Specialists represent that they hold valid professional credentials in their stated discipline and jurisdiction, and that all work delivered meets applicable professional standards.

Users are strictly prohibited from:

• Uploading plagiarized, fraudulent, or rights-infringing content.
• Manipulating metadata, LOD classifications, or descriptions to mislead other users.
• Creating multiple accounts to evade restrictions or penalties.
• Contacting other users to complete transactions outside the Platform.
• Using the Platform for money laundering, fraud, or any illegal purpose.
• Reverse-engineering, scraping, or accessing the Platform by unauthorized automated means.
• Transmitting malware, spam, or harmful code.
• Impersonating another person or entity.

All transactions are denominated in USD and processed through Stripe. PE BIM LLC is not responsible for currency conversion fees charged by banks or payment processors.

Each user is solely responsible for reporting and paying taxes arising from their use of the Platform in their respective jurisdiction. PE BIM LLC does not withhold taxes for Creators or Specialists domiciled outside the United States. For US-based users, PE BIM LLC will comply with applicable IRS reporting requirements (Form 1099-NEC where required by law).

The Platform uses cookies and similar tracking technologies to operate, analyze, and improve its services. By using the Platform, you consent to the use of cookies in accordance with our Privacy Policy (English) and Aviso de Privacidad (Spanish). You may manage cookie preferences through your browser settings or the consent banner displayed on your first visit.

You agree to indemnify and hold harmless PE BIM LLC, its officers, employees, and agents from any claims, liabilities, damages, and expenses — including reasonable attorneys’ fees — arising from your use of the Platform, your content, or your violation of these Terms.

These Terms are governed by the laws of the State of California, USA. Any dispute shall be resolved by binding arbitration administered by JAMS in San Diego, California, under its International Arbitration Rules, conducted in English.

Class Action Waiver. You waive any right to participate in a class action lawsuit or class-wide arbitration against PE BIM LLC.

Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent irreparable harm.

PE BIM LLC may update these Terms at any time. Material changes will be notified at least 30 days in advance via the Platform or email. Continued use after the notice period constitutes acceptance.

PE BIM LLCmay suspend or terminate access upon 15 days’ notice, or immediately for fraud, material breach, or illegal activity. Client licenses for previously purchased BIM projects survive termination.

Entire Agreement. These Terms, together with our Privacy Policy and applicable Creator, Specialist, or Client agreements, constitute the entire agreement between you and PE BIM LLC.

Governing Language. The English version of these Terms prevails in the event of any conflict with a translation.

Severability. If any provision is unenforceable, the remaining provisions remain in effect.

Assignment. You may not assign your rights under these Terms without PE BIM LLC’s prior written consent.
